A-1 – Agricultural District Regulations

 

SECTION 401. INTENT AND PURPOSE.

This district is intended for agricultural and single family residential uses together with compatible uses.  The purpose of this zone is to encourage the preservation of agricultural farming practices.

SECTION 403.  USES PERMITTED BY SPECIAL USE PERMIT.


(1)        Kennels

(2)        Production of Fur Bearing Animals

(3)        Grain and Seed Elevators

(4)        Livestock Auction Yards

(5)        Bed and Breakfasts

(6)        Veterinary Hospitals

(7)        Recreational Vehicle Campground

(8)        Religious, Social, Educational and Human Care Institutions

(9)        Golf Courses

(10)      Public Parks

(11)      Public and Private Airports

(12)      Soil Resource Extraction

(13)      Temporary Outdoor Uses

(14)      Accessory Uses for 1-13


 

Regulations for Special Uses are found in Chapter 14, Special Land Use Permits.

 

SECTION 404.  DIMENSIONAL REGULATIONS.

(1)        Lot Area, minimum – Forty-three thousand, five hundred and sixty (43,560) square feet

(2)        Lot Width, minimum – One hundred and fifty (150’) feet.

(3)        Front Yard, minimum – Fifty (50’) feet.

(4)        Back Yard, minimum -  Twenty-five (25’) feet.

(5)        Side Yard, Minimum - Each side, fifteen (15’) feet, where an A-1 and C or I district abut,

the side yard shall be fifty (50’) feet in the C or I district.

(6)        Housing Unit, Minimum – Eight hundred forty (840) square feet.

(7)        Height, maximum – Two and one half (2.5) stories, not exceeding a total height of thirty-five (35’) feet.  Accessory structures: Agricultural structures may not exceed eighty-five (85’) feet.  Non-agricultural structures may not exceed fourteen (14‘) feet wall height.

(8)        Lot coverage, maximum percent- none.

(9)        Accessory Structures -  No accessory Structures may be located closer than ten (10’) feet to the principal structure, nor erected in any required yard, except as provided in section 1105(1).

                                 Subsection (7) amended by Ordinance 04-05, eff October 7, 2004.  

                              

                 Prior to the 2006 amendment, subsections (7) & (9) read as follows:

                 (7)  Height, maximum – Two and one half (2.5) stories, not exceeding a total height of thirty-five (35’ feet.  Accessory structures may not exceed eighty-five (85’) feet”.

                       (9)  Accessory Structures -  No accessory Structures may be located closer than ten (10’) feet to the principal

                       structure”.

                       Prior to 2004 amendment,  subsection (7) read: “Thirty-five (35’) feet or two and one half (2.5) stories. Accessory

                       structures may not exceed eighty-five (85’) feet”.

 

SECTION 405.  ANIMALS AND ANIMAL HOUSING AND SHELTERS.

 

(1)        No structure or building intended for use as housing or shelter for animals, other than those commonly known as “pets”, shall be used, moved to, or constructed on a parcel or lot of less than five (5) acres, or within two hundred (200) feet of a dwelling located on an adjacent parcel or lot.

(2)        No kennel license shall be issued to any resident, without first obtaining written approval from the Zoning Administrator.

(3)        No animals, other those commonly known as “pets”, shall be kept on any parcel or lot unless the property complies with section 405(1).             

(4)        Pets are defined as cats and dogs.       

                Historical Notes:  Subsection (1) amended, and subsection (4) added by Ordinance 10-02, eff Oct 7, 2010.

 

Prior to the 2010 amendment, subsection (1) read as follows:

“(1)          No structure or building intended for use as housing or shelter for animals, other than those commonly known as “pets”, shall be used, moved to, or constructed on a parcel or lot of less than five (5) acres, or within two hundred (200) feet of an existing dwelling, nor shall a dwelling be constructed or moved within two hundred (200) feet of a structure that is intended for, or is in use as, housing or shelter for animals other than “pets”. Pets are defined as cats and dogs.”

 

SECTION 406.  PARKING REGULATIONS.

Every land use that has employees working on the site must have one parking space for each employee in addition to the parking required for a use of its type.
